Validity / Invalidity Search

Invalidity or a validity search is conducted to determine the prior art that has the capability of invalidating or revoking a patent. An invalidity search or validity search is a comprehensive search of all publicly available valid documents published prior to the patent in question. We provide a claim mapping to establish validity or invalidity of a granted patent. Each claim element is mapped with the cited reference text and highlighted accordingly.

A detailed analysis of file wrapper or prosecution history is a critical component of our searches. Based on the 'intrinsic' and the 'extrinsic evidence', our analysis helps in building a sound argument.

Infringement Analysis

An infringement search is conducted in order to determine a probable list of product(s) from companies or manufacturers, which might potentially infringe the claim(s) of a patent. In order to conduct an infringement analysis, firstly the scope of the claim(s) is determined and then checked whether all elements of the claim(s) are present in the product or process.

Infringement analysis is generally done before launching a product or process in a particular country. Infringement analysis may also be done for litigation support proceedings.

Understanding claim construction and determining whether there is infringement risk is a complex process that often involves esoteric analysis. Our patent experts help you understand the various risks involved and to determine if you are legally able to sell a product you have developed.

Our infringement search report includes potential product list with a High, Medium or Low confidence level rating based on probable mapping of product with the claim.

We have extensive in-house capabilities to perform the technical evaluation of products and devices to look for evidence of use of the patented technology.
